Support for the Rule of Law
A country without the rule of law faces profound challenges, including rampant corruption, instability, State power is being abused, economic collapse, widespread rights abuses, and lack of accountability and personal security, as laws aren’t applied equally, institutions are weak or arbitrary, and citizens lack protections for life, property, or fair treatment, leading to societal chaos and development failure, individuals having no fear of punishment for their wrongdoing, leading to a breakdown in order and potentially the rise of vigilantism and the government is unable to collect taxes, enforce the law, provide security, control territory, provide for political or civil functions, and maintain infrastructure.
Supporting the rule of law involves implementing, enforcing and defending international rule of law in all countries and international jurisdictions, ensuring that the law is applied fairly and consistently, and upholding principles such as equality before the law, accountability, transparency and the independence of the judiciary, championed by legal bodies, governments, educational systems and citizens, often through measures such as protecting the judiciary, improving access to justice, promoting public legal education and ensuring fair legislation, despite the growing global challenges that threaten these foundations. Everyone, including public authorities or governments, is subject to the international rule of law and must be accountable for it.
The International Rule of Law is crucial because it ensures that everyone, is subject to the law, thus laying the foundation for a stable society by protecting individual rights, preventing arbitrary abuse of power, promoting economic growth, and fostering trust in the legal system, thus contributing to the proper functioning of a democracy. It is regarded as the cornerstone of a just and fair society and is based on fundamental principles ensuring that everyone, including the government, is subject to and accountable to the law, promoting equality, predictability and fairness, and demanding accessible and clear laws, independent courts, judicial independence and the protection of fundamental rights such as fair trials and open justice.
“It’s a Right to protect against intolerable wrongs—no matter who you are.”
